The Demise of the 28-Point Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis caused by the presentation of a new comprehensive peace framework for ending the war appeared – briefly – to have been defused. A senior US official spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of conflicting incidents captured the bleak nature of the outgoing year. By day, diplomatic battles are waged: positive announcements are issued from different nations. Considerable effort is allocated on containing specific proposals. By night, Moscow brutally reminds the world that, for them, war remains the primary tool for achieving "resolution".

After-Dark Attacks

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was laid bare. Ukraine is capable of detecting missile launches from across the border, a capability provided through up-to-date information. From vantage locations, defense planes that had been scrambled to counter approaching aerial threats flew past – sophisticated military planes provided to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons thundered: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by partner states. Every deployment shakes the surroundings, rattling buildings. The moment of terror quickly gives way to resigned acknowledgment: possibly the incoming missile won't hit its mark this time, sparing the city from devastation and additional electricity failures.

Ongoing Risks

Soon after, a large-caliber weapon engaged a aerial vehicle close by, part of a rapid response unit – almost certainly Western-made equipment. Sadly, the shots failed to hit the opposing UAV – it pressed on overhead toward its objective.

Periodically, this persisted until dawn. Kyiv faced the morning news: multiple fatalities, destruction and heating outages in multiple buildings as a result of the nocturnal offensive. As always, everyone still went about their day – living the war. But those full day encapsulated Ukraine's critical military reliance on Western support – a dependence that neighboring countries are clearly incapable to substitute in the short term.

Unsuccessful Negotiations

The comprehensive proposal from US administration provoked deep reactions, debate and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new proposal from American administration unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They stabilise the situation but never actually secure success. This trend will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the whole story. Washington functions according to a assumption well known to seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration assumes that it is unrealistic to force Russia to abandon the territory that it currently occupies in Ukraine's occupied territories.

The problem is that while recognising this factual reality, American administration does minimal to deter Moscow, through statements or actions, from thinking that the situation will not shift further in its advantage in the near future.

Conflicting Perspectives

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its allies are approaching exhaustion. Their incentive to sign a deal that does not give them the greatest potential benefit is almost completely absent. There may be numerous efforts to end hostilities, but they will persist as long as Russia's leader remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing people and territory but averting a entire defensive failure until conditions improve in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, individual motivations are becoming relevant: personal goals to broker a ceasefire and achieve global acclaim, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any proposal Kyiv finds unsuitable, so that their focus does not move to domestic problems. And although their objective will now be much harder after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are influencing discussions.

Summary and Prospects

It took a only one week to terminate the suggested clauses of the most recent proposal. Forceful and unpredictable management of the matter by Washington, opposition by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, current information leaks, all did their job.

While new initiatives based on established approaches are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are founded on Moscow's terms and demonstrate certain reluctance to change the course of events, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, largely rely on sustained allied backing.
